A defendant shall be punished by imprisonment with prison labor for not more than ten months.
Seized evidence 3 or 4 shall be confiscated from the accused.
Reasons
Punishment of the crime
1. Violation of the Electronic Financial Transactions Act;
(a) In using and managing a means of access to a means of access, no person shall receive, request or promise to receive or lend a means of access, or keep, deliver or distribute a means of access, unless otherwise specifically provided for in other Acts;
On October 2018, the Defendant sent 2 C a written message stating that “If he/she lends it for the purpose of tax reduction or exemption, he/she will pay 80,000 won per day, if he/she lends it to a third party.” On October 23, 2018, the Defendant thought that he/she would use 4,800,000 won in cash from his/her name in the E office located in Bupyeong-gu Incheon Metropolitan City, in a way that he/she packages 2 physical card to a box and sends 2,000 won in his/her name, and then sent 2,000,000 won in cash from the Defendant’s company bank account (Account Number F) and the Nong Bank account (Account Number G) and sent 2, which is linked respectively, to the above account number and password.
As a result, the Defendant promised to receive compensation from a person with no name, and lent the means of access respectively.
(b) In using and managing the means of access to a crime, no person shall borrow or lend the means of access or keep, deliver or distribute the means of access with the knowledge that the means of access is to be used for a crime or will be used for a crime unless otherwise specifically provided for in other Acts.
1. On January 3, 2019, the Defendant, as stated in the above-mentioned 1-A, came to contact with a person who was not a person with the name, and, on November 1, 2018, came to receive a proposal as to whether he/she was an employee of the distribution of the passbook for the use of the name, who was an employee in charge of the distribution of the passbook for the use of the name, and as to whether he/she would work together, around December 25, 2018.
