Defendant

A shall be punished by a fine for negligence of KRW 2,500,000, and by a fine of KRW 800,000.

The above fines are imposed by the Defendants.

Punishment of the crime

Defendant

A is a loan-related financing owner while operating a mutual insurance agency as a D agency.

E is a person who has been operating an unregistered credit business office in the trade name of G in Seo-gu, Daejeon.

B and H are those who work at a D agency operated by A.

1. A person who intends to engage in the joint criminal administration credit business by Defendant A and E shall register with the Daejeon Metropolitan City Mayor, and a credit service provider shall not exceed 30% per annum, which is the interest rate provided for in the Enforcement Decree of the Credit Business Act, when granting a loan to an individual or a small-scale corporation;

A and E conspired, around December 21, 2012, operated a lending company of G without registering, at the J coffee shop located in Seo-gu, Daejeon, Seo-gu, Daejeon, with the loan of KRW 1,20 million to K, deducted KRW 1,80,000 as a fee, and transferred KRW 3,60,000 as interest during five months, and violated the statutory interest rate limit of KRW 39,000 as 98 percent with the deposit of KRW 3,60,000 as interest rate, from that time until May 30, 2013.

2. When Defendant A, B, and H were unable to borrow their loans and recover their claims as stated in the foregoing 1., Defendant B and H’s request for debt collection to Defendant B and H for the act of assaulting, threatening, arresting, or detaining the debtor or his related person, or using deceptive scheme or force against the debtor in debt collection conducted by Defendant B and H.

Nevertheless, it decided to collect the claim by visiting the workplace and residence for the reason that the debtor did not repay the debt by telephone.

Defendants and H around 14:00 on November 23, 2013, at the time of “M” retail store operated by the Victim K located in the Dong-gu Daejeon-gu Daejeon, and H.
