1. The Defendants are jointly and severally and severally liable to the Plaintiff for KRW 324,127,751 and KRW 313,753,479.
Reasons
1. Basic facts
A. Defendant B is an owner operating the Serial system, and Defendant C is an infant of Defendant B.
B. Defendant B, upon obtaining Defendant C’s consent on November 23, 2014, organized and operated the same title system over a total of six times until July 6, 2017, as indicated in the following table, including the organization and operation of the title system of 20 million won in total (based on No. 50 million won) on the ground that Defendant C was an owner of a fraternity, and the Plaintiff joined the said title system and paid the fraternity.
(2) On March 23, 2015, KRW 2970,000,000 from May 13, 2015, KRW 3940,000 to November 6, 2015, KRW 2940,000 on May 6, 2016, KRW 29440,00 on May 6, 2016, KRW 250,000 on July 23, 2016, KRW 40,00 on July 24, 2016, KRW 50,00 on July 23, 2016, KRW 167,00 on May 16, 207, KRW 206,00,00 on May 16, 2017.
C. On March 23, 2015, the Plaintiff did not receive KRW 50 million, which he/she would receive according to the sequence 1, 2015 No. 1, and instead lent the said amount to Defendant B by setting the interest rate of KRW 1.2% per month.
In addition, the Plaintiff loaned money to Defendant B on several occasions under the same conditions. The loan certificate drawn up as of March 23, 2015, July 23, 2015, September 23, 2015, February 6, 2016, January 13, 2017, and February 6, 2017 between the Plaintiff and the Defendant was written as the principal obligor or the joint guarantor, and the seal of Defendant C is affixed thereto.
C. The plaintiff
Upon a request for the repayment of the loan mentioned in paragraph (1), Defendant B shall aggregate the amount of the existing debt against the Plaintiff to be settled, and Defendant B shall pay KRW 50 million from January 6, 2018 to May 6, 2018, the amount of the five loan equivalent to KRW 315 million,00,000,000 from January 6, 2018, KRW 2,000,000,000 from January 6, 2018, KRW 50,000,000,000 from January 13, 2018, KRW 15,000,000 from January 23, 2018, KRW 50,000.
