A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Fraud of loans;

A. On December 21, 2012, around 11:03, the Defendant concluded that “The Defendant sent money to the Defendant via the Kakakao Kakao Kakao Messen, and if you send KRW 2,00,000,000,000,000,000 won, it would return money to the Defendant.”

However, in fact, there was no intention or ability to repay the money borrowed from the victim according to the agreement, as well as the plan to use the money to repay the debt to others.

Ultimately, the Defendant, by deceiving the victim as above, received 2 million won from the victim to the account in the name of the Defendant at around 11:12 on the same day.

B. At around 12:38 of the same day, the Defendant: (a) provided the Victim with the Kakakao Kakao Kakao Kakao Massen, that the Defendant would not be said to have any money now paid to the Defendant for the payment of the money that he had been old in Seoul, and (b) provided the Defendant with a loan of KRW 2 million,00,000,000,000,000,000 won.

However, in fact, there was no intention or ability to repay the money borrowed from the victim according to the agreement, as well as the plan to use the money to repay the debt to others.

Ultimately, the Defendant, by deceiving the victim as above, received KRW 2 million from the victim to the account in the name of the Defendant at least 13:32 on the same day, and acquired it by fraud.

C. On December 22, 2012, around 09:37, the Defendant made a false statement to the Defendant that “Around 09:37, the Defendant borrowed only KRW 2 million from the Plaintiff via the Kakakakao Kakao Kakao Messens, which would be able to send money to female students, as it is necessary for female students to travel.”

However, in fact, there was no intention or ability to repay the money borrowed from the victim according to the agreement, as well as the plan to use the money to repay the debt to others.
