1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. The assertion and judgment

A. The Plaintiff’s assertion 1) The Defendant is the Plaintiff’s 19 kinds of non-commercial currency (hereinafter “each of the instant virtual currency”) between January 2018 and May 2018.

(2) In soliciting investment in each of the instant virtual currency, the Plaintiff deceivings the Plaintiff to the effect that each of the instant virtual currency will be listed in the Coin Exchange within a number of months, and that if listed, it would be able to earn a profit of KRW 52,651,145. The Plaintiff purchased four bitcoin equivalent to KRW 326,985,650 in the name of the purchase fund of each of the instant virtual currency, and deposited them out to the Defendant’s personal account (non-ccoin or Etco). The Defendant paid KRW 3 million to the Defendant, thereby making an investment of KRW 382,636,795 in total. However, some of the instant virtual currency recommended by the Defendant to make an investment was not listed, and the amount of some of the virtual currency listed was substantially lower than the assessed amount at the time of purchase, thereby causing damage to the Plaintiff’s investment KRW 382,636,795 in this case.

3. Therefore, the defendant is liable to compensate the plaintiff for the damages incurred by the above illegal act, the above 382,636,795 won and the damages incurred by delay.

나. 판단 갑 제1, 3, 4호증의 각 기재 및 변론 전체의 취지에 의하면, 피고가 원고에게 2018. 1. 12. ‘상장 시기는 2월말에서 3월초이며 5 ~ 6월 3,000원대 이상 분명 갈 것 같습니다’, 2018. 1. 14. ‘제가 말씀드린 비트, 이더, 비캐, 라이트, 큐텀은 단기가 아닌 최소 6개월을 보유하시면 분명 2배 이상 튈 코인입니다‘, 2018. 1. 17. ’최소 6개월간 버틸 수 있는 여유로 코인투자를 해야 한다는 것이구요. 결국 해답은 프리세일 그것도 성공확률이 높은 것만 족집게로 들어가는 것이 최고인 듯합니다‘, 2018. 3. 7....
