A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, who died on March 30, 199, married on September 19, 194, and married on September 20, 194, but knew that D was registered as a person living together with the Defendant’s resident registration card even though it is unknown whether D was divorced on August 20, 1994, the Defendant used this information to deny the Defendant’s request for D as a recipient under the National Basic Living Security Act, etc., and to receive the benefits and the pension to be paid to D.
1. On March 26, 2004, the Defendant violated the National Basic Living Security Act: (a) at the Uljin-gun’s Eup office located in the Ulsan-gun, Ulsan-gun, Chungcheongnam-do; (b) as seen above, D, whose life or death is unknown, resides together with the Defendant; (c) submitted D’s “application for the payment of welfare benefits” under the name of D as if he was supported by the Defendant; and (d) applied for payment of benefits under the National Basic Living Security Act by fraudulent means.
However, as seen above, the Defendant was living alone in the Defendant’s residence located in the G in the G in the G in the G in the G in the G in the G in the G in the G in the G in the G in the G in the G in the G in the G in the name of D, and there was no eligibility to apply for the benefits under the National Basic Living Security Act, and there was no right to receive the benefits.
Nevertheless, the Defendant filed a false application for the payment of the National Basic Living Security Act and received KRW 257,240 from the account in the name of D on April 20, 204. From that time to December 18, 2015, the Defendant denied a total of KRW 40,879,140, including the living wage and the housing wage under the National Basic Living Security Act, in total of 142 times, from around December 18, 2015.
2. The Defendant violated the Basic Pension Act: (a) filed a false application for benefits under the National Basic Living Security Act in the name of D in the date and place specified in paragraph (1); and (b) implemented the Basic Old Age Pension Act (amended to the Basic Pension Act on May 20, 2014) on January 1, 2008.
