A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. On February 2, 2018, the Defendant: (a) stated that “The Defendant would set up a production team for the production of a ice design project broadcast program, and pay the production cost of KRW 4,500,000 per month for the production of the program under the direction of the production team.”

However, since the defendant was economically difficult, the victim did not have the intent or ability to pay the production cost of the program even if the victim organized the production team of the program and directed the team to produce the program.

Nevertheless, the Defendant, by deceiving the victim as above, did not pay KRW 18,00,000 to the victim for expenses incurred in the production of a program for a total of four months from May 2018 to August 2018, and did not pay KRW 18,00,000 to the victim for the production of a program.

2. On August 31, 2018, the Defendant said that “The Defendant’s joint and several liability fraud was a joint and several liability guarantee letter for the said obligation, since the investment of KRW 1,200,000,000 from S was determined by the Plaintiff and the Plaintiff was made in around September 20, 2018.” On September 20, 2018, the Defendant said that “A joint and several liability guarantee letter for the said obligation is changed, on the ground that there was no problem in paying KRW 118,224,90, the benefits to be paid to the program production team when the investment amount was made.”

However, in fact, the defendant was notified of non-investment in S Co., Ltd., and there was no particular property or income, so there was no intention or ability to pay close benefits to the manufacturing team.
