2. Judgment on a counterclaim

A. The Defendants asserted that the Plaintiffs are using the instant passage, and that they have the right to passage over the surrounding land against the instant passage. Therefore, the Plaintiffs asserted that the Defendants are obligated to pay the amount equivalent to the rent for the instant passage with compensation for damages pursuant to Article 219(2) of the Civil Act.

B. According to Article 219(2) of the Civil Act, where the right to passage over surrounding land is recognized, the person who has the right to passage over surrounding land should compensate for the damages of the person who has the right to passage over surrounding land. In ordinary, the amount is the amount equivalent to the rent for the land as the amount of profit
