2. Determination as to the cause of action

A. The Defendant is liable to pay the unpaid wages, etc. to the Plaintiff for three-month wages, refund for year-end settlement, and retirement allowances.

나. 액수 ⑴ 3개월분 임금; 13,846,155원 ㈎ 위 증거들에 의하면, 2015. 5. 이후 원고의 월 급여액은 4,615,385원(＝기본급 4,315,385원＋식대 100,000원＋차량유지비 200,000원)인 사실을 인정할 수 있다.

(원고는 피고 회사에 근무하는 내내 자신의 월 급여액이 5,000,000원이었고, 여기서 세금 등을 공제한 잔액 4,463,080원이 실 수령액이었다고 주장한다. 그러나 위 증거들에 의하면, 원고는 2015. 3.과 2015. 4.에는 월 4,463,080원을, 그 이후에는 월 4,078,495원 ~ 4,112,395원을 수령한 사실을 인정할 수 있다. 위 금액 차이가 약 40만 원에 가까운 것에 비추어 보면, 2015. 5. 이후의 월 급여액은 5,000,000원이 아닌 4,615,385원이었다고 보는 것이 옳다. 원고의 위 주장은 이유 없다.) ㈏ 2015. 10.분, 2015. 11.분, 2016. 8.분 총 3개월분 임금 합계액은 13,846,155원(＝4,615,385원×3)이다.
