Reasons
Punishment of the crime
The defendant purchased a large quantity of personal information files leaked from various web sites, and then let the employees recruited through the Internet job placement site access the above personal information to the web site including NAVB and transmit the various advertising pages to the unspecified number of members of the web site, thereby gaining profits such as advertising expenses.
1. Violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc.;
A. 나. 피고인은 2014. 2. 6.경 서울 용산구 이태원동 소재 상호 불상의 카페에서, ‘C’ 등의 네이버 웹사이트의 회원 이메일 주소 도합 9,951,006건이 저장된 개인정보 파일 ‘NAVER★RLSMASTERS.txt’가 불상의 방법으로 누설된 사정을 알면서도 인터넷을 통해 알게 된 신원 불상인(일명 D)으로부터 네이트온 메신저를 이용해 위 파일을 받아 개인정보를 활용하여 부당한 방법으로 광고 등을 할 부정한 목적으로 개인정보를 제공받았다.
