The plaintiff has a bankruptcy claim of KRW 121,842,421 against the bankrupt building company.

1. Basic facts

A. On March 6, 2012, the Plaintiff completed the said construction work on May 30, 2012 by accepting a subcontract (hereinafter “instant subcontract”) with the construction cost of 2,603,573,165 won, and three years for the warranty liability period of 2,603,573,165 won, and the warranty liability period of 3 years, respectively.

B. On June 26, 2012, the construction of a new apartment was completed.

C. As a result of the occupancy of the above apartment, it was notified that the Plaintiff will fully bear the repair cost in the brick construction when requesting the repair of the defects in the floor of each of the above apartment units, and the repair of the defect caused by the error of the brick construction.

From June 1, 2012 to November 9, 2012, the Plaintiff: (a) carried out a defect repair work (hereinafter “instant defect repair work”) at KRW 176,257,500, based on the following details.

A rehabilitation procedure was commenced for brick construction. The plaintiff filed the lawsuit in this case with the content that the plaintiff claimed KRW 154,466,721 and value-added tax for the total amount of KRW 15,446,672 and KRW 169,913,393, which had already been paid for the defect repair costs of KRW 176,257,50 and KRW 7,841,60, and KRW 3,949,179.

E. Since then, rehabilitation procedures were abolished for the construction of brickd Construction, and on April 16, 2014, the bankruptcy was declared by the Seoul Central District Court 2014Hahap63, and the Defendant was appointed as the bankruptcy trustee.

On July 10, 2014, the Plaintiff reported the defect repair expense claim of KRW 154,446,721 as bankruptcy claim under the above bankruptcy procedure. However, the Defendant reported the defect repair expense claim of KRW 154,446,721.
