1. The plaintiffs' claims against the defendants are all dismissed.

Purport of claim

1. The plaintiffs

(a) As to each real estate listed in the separate sheet:

(1) The Defendant ○○○○ or the ○○○○○○○○○○○ registry office of 2004, Oct. 26, 2004, made on the commission of a provisional disposition registration No. 161920, the registration of preservation of ownership;

(2) The Defendant ○○○, Kim○, Han-○, Han-○, Gan○, Gamb○, Gamb○, Gim○, ○○○○, and 00 ○○ District Court’s ○○○○○ Registry on October 26, 2004, followed each procedure for registration of cancellation of each registration of the establishment of a neighboring mortgage, which was made on October 26, 2004.

B. As to each real estate listed in the separate sheet Nos. 1 through 5, 9, 13, and 14

(i)Implementation the procedure for cancellation of the registration of the right to claim the transfer of all co-owners' shares, which was made on October 26, 2004 by the ○○ District Court ○○○○ Registry, 2004, No. 161

(2)In relation to the registration of cancellation as described in paragraph (1) of the above A, the declaration of acceptance shall be made.

C. Defendant Lee ○-○

(1) The procedure for the cancellation of the provisional registration of the right to claim the transfer of all co-owners' shares, which was made on October 26, 2004 by the ○○ District Court ○○○○ registry office of registry on the real estate stated in paragraph (10) of the attached list;

(2) As to the real estate listed in Section 6 and Section 10 of the Schedule, an expression of consent is made with respect to the registration of cancellation described in Section 6-A(1) of the Schedule.

D. As to the real estate listed in [Attachment] Nos. 7 and 8 of the Schedule, Defendant Kim ○○ shall:

(1) ○○ District Court ○○ registry office 2004. 26 October 26, 2004 followed the procedure for cancellation of the registration of the right to claim the transfer of all co-owners' shares or the right to claim the transfer of all shares.

(2)With respect to the registration of cancellation as referred to in paragraph (1)(1) above, an expression of consent will be made.

E. Defendant ○○○ shall implement the procedure for the cancellation of registration of the right to claim the transfer of all co-owners’ shares, which was made on October 26, 2004 at the ○○ District Court’s ○○○○○ Registry on the real estate listed in paragraph (11) of the attached list.

F. Defendant Han-○

(1) The procedure for the cancellation of the provisional registration of the right to claim the transfer of all co-owners' shares and the right to claim the transfer of all co-owners' shares, which was made on October 26, 2004 by the ○○ District Court ○○○○ Registry of ○○○○ (hereinafter referred to

(2) As to the real estate listed in Section 11 and Section 15 of the Schedule, an expression of consent is made with respect to the registration of cancellation described in Section A(1) of the Schedule.

G. As to the real estate listed in paragraph 12 of the attached Table, Defendant Kim ○○ shall:

(1)Implementation the procedure for cancellation of the registration of the provisional right to request the transfer of all co-owners' shares, which was made on October 26, 2004 by the ○○ District Court ○○○ registry office 161924;

(2)With respect to the registration of cancellation of subsection (1) of this paragraph, the declaration of consent shall be made.

H. As to the real estate listed in [Attachment] No. 16 of the Schedule:

(1)Implementation the procedure for cancellation of the registration of the right to claim the transfer of all co-owners' shares, which was made on October 26, 2004 by the ○○ District Court ○○○○ Registry 2004 No. 16192

(2) A. (1) The declaration of consent to the registration of cancellation is made.

I. The defendant ○○○ or the same 000 ○○○ established by the ○○ District Court’s ○○○ registry office on October 26, 2004 with respect to the real property listed in paragraph (6) of the attached Table No. 6 of the attached Table, shall implement the procedure for the cancellation of the registration of the right to claim a transfer of all co

(j) Defendant ○○○ has performed the procedure for registration of cancellation of the registration of establishment of a mortgage on the entire shares of ○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○, which was made on January 6, 2005

(k) As to the real estate listed in paragraph (7) of the attached list, the defendant Seoh○○, as to the real estate listed in paragraph (14) of the attached list, the defendant Seoh○, Kim○, and the Republic of Korea as to each real estate listed in paragraph (1) of the attached list as to each real estate listed in paragraph (1) of the above B, among the cancellation registration listed in paragraph (1) of the attached list, expressed its intention of acceptance

Reasons

1. Basic facts

A. While ○○ Construction Co., Ltd. (hereinafter referred to as “○○○ Construction Co., Ltd.”) was contracted by Defendant ○○○○ (a director of ○○○○○) to construct each real estate listed in the separate sheet (hereinafter referred to as “each of the instant real estate”) and performed a new construction project for each of the instant real estate listed in the separate sheet (hereinafter referred to as “instant construction project”), the construction project was suspended on or around February 2004 due to the shortage of funds.

B. On February 16, 2004 and March 2, 2004, the ○○○○○○, the nominal owner of the construction permit, and the ○○○○○ (the auditor of the ○○○○○○○○ and the ○○○○○ case), who is the nominal owner, agreed to complete the registration of ownership preservation of each of the instant real estate in the name of the representative selected by the subcontractor and the construction financing lessee (hereinafter referred to as the “contractor”) after completion of the construction work in cooperation with the subcontractor, and the construction was resumed accordingly.

C. Thereafter, around April 2004, Defendant ○○○ and ○○○○○○ used the site for each of the instant real estate (former lot number ○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○ as collateral, borrowed 1.6 billion won each from Defendant ○○○○○○○○○○, 60 million won each from Defendant Kim○○○○○, and 3.3 billion won each from Defendant Kim○○○○○○○○○○○○○, and thereafter, used the land price and construction cost. Around that time, the name of the owner of the instant construction was changed from Defendant ○○○○○

D. On October 25, 2004, immediately before the completion of each of the real estate in this case, Defendant Lee ○○, Kim ○○, Kim ○○, Lee ○○, Lee ○○, and Park ○○, a lessee of the construction cost, the right to claim the registration of additional establishment of a mortgage over the security agreement of Defendant ○○○, etc. and the right to claim the registration of ownership transfer based on a payment in substitutes contract, as the right to be preserved, in regard to each of the real estate in this case (○○ District Court 2004Kahap145, ○○○, but Defendant Lee ○, as to the real estate in this case, the first through 5,9,13, and 14; Defendant Lee○, as to the 6,10 real estate in this case; Defendant Lee ○, as to the 7,8 real estate in this case; Defendant Kim ○, as to the 11,15 real estate in this case; Defendant Kim ○○, as to the real estate in this case, was entrusted by the court 16400.

E. On the other hand, around December 2, 2004, the name of the owner of the instant construction was changed to that of Defendant ○○ sole name.

Facts without dispute over the basis of recognition, entry of Gap evidence 8-9 through 24, 9, and 10, and the purport of the whole pleadings

2. The assertion and judgment

A. The plaintiffs' assertion

The plaintiff asserts that since the plaintiffs were selected as the title holder of the registration of the ownership of each real estate of this case, the ownership of each real estate of this case was originally reverted to the plaintiffs according to the agreement of this case, and as a result, the registration of the ownership preservation in the name of defendant ○○○ and Y○○○○ shall be cancelled as invalid registration. The other defendants, who are the title holder of the registration of the establishment, provisional registration, provisional seizure, provisional disposition, etc. of the real estate of this case, based on the above registration of the ownership preservation as stated in the purport of the claim, have the obligation to cancel each registration in their names or to accept the registration of the cancellation thereof.

B. Determination

살피건대, 원고들과 피고 ○○○ 사이에 '준공검사 이후 이 사건 각 부동산에 관하여 이 사건 공사채권자의 대표자 2인 명의로 소유권보존등기를 마치기'로 하는 이 사건 합의가 이루어진 사실은 앞서 본 바와 같고, 갑 제1, 2호증, 제3호증의 1, 11의 각기재에 변론 전체의 취지를 종합하면, 이 사건 공사뿐만 아니라 ○○종건이 이 사건공사현장 옆인 ○○시 ○○동○○, ○○ 양 지상에서 시행하고 있던 빌라신축공사의 여러 공정을 하도급받아 시행한 하수급인 및 두 공사현장에 자재를 납품하였거나 ○○종건, ○○○, 피고 ○○○ 등에게 공사자금을 대여했던 금전채권자들인 김○○(석재납품), 서○○(물품납품 및 설치), 전○○(대여), 주식회사 ○○산업개발(조경공사), 주식회사 ○○산업(도장공사), ○○○(조경공사), 최○○(대여), 김○○(인테리어공사), 윤○○(대여), 김○○(석재공사), 주식회사○○(일반가구 및 주방가구 납품 및 설치), 박○○(전기공사), 임○○(대여), 주식회사 ○○(미장 · 방수공사), 최○○(대여), 김○○(타일 · 위생기설치공사), 김○○(대여), ○○○(대여), 서○○(대여), ○○○(창호공사), 최○○(대여), 안○○(채권양수), 강○○(골조공사) 등이 2005. 4. 30.경 이 사건 합의에 따른 자신들의 대표자로서 원고들이 선임하고 자신들의 ○○종건 및 피고 ○○○에 대한 잔여채권 전부를 원고들에게 양도한 사실, 그 무렵 위 채권양도의 통지가 ○○종건 및 피고 ○○○에게 도달한 사실은 인정되나, 한편, 갑 제8호증의 1 내지24. 제9호증의 각 기재에 변론 전채의 취지를 합합하면 이 사건합의가 이루어질 당시 이 사건 공사의 공정률은 70%로서 마감공사를 남긴 채 4층 연립주택인 이 사건 각 부동산의 4층 전체의 골조와 지붕의 공사가 완료되어 있었던 사실이 인정되는바, 위 인정사실 및 ○○종건이 이 사건 공사에 관하여 일괄하도급계약을 체결하지 아니하고 여러 공정별로 하도급계약을 체결한 점, 본래부터 이 사건 건축허가명의는 수급인인 ○○종건이 아니라 도급인인 피고 ○○○ 명의로 되어 있었고, 이 사건 공사가 중단된 2004. 2.경 이루어진 이 사건 합의도 수급인인 ○○종건이 아닌 도급인인 ○○○과 원고들 사이에 이루어진 점, 이 사건 합의 이후에도 건축주명의가 수급인인 ○○종건이나 하수급인을 비롯한 이 사건 공사채권들이 아닌 피고 ○○○, 임○○ 공동명의로 변경된 점, 통상 건축 중인 건물에 관한 사실상의 소유권의 이전은 건축허가명의 변경의 방식으로 이루어지고 있는 점 및 이 사건 합의 전후를 통하여 ○○종건, ○○○,피고 ○○○ 등이 공사자금을 계속 조달하였던 점 등을 종합해 보면, 이 사건 수급인인 ○○종건과 도급인인 피고 ○○○ 사이에는 본래부터 신축건물인 이 사건 각 부동산의 소유권을 피고 ○○○이나 그로부터 건축허가명의자의 지위를 양도받은 자에게 귀속시키기로 하는 묵시적인 특약이 있었다고 봄이 상당하고, 그 밖에 ○○종건이 이 사건공사에 관하여 원고 허○○을 비롯한 하도급업자들과 하도급계약을 체결한 당시 이 사건 각 부동산의 소유권귀속에 관하여 이와 다른 특별한 약정을 하였음을 인정할 증거도 없다. 그렇다면 앞서 인정한 바와 같이 이 사건 공사가 중단될 무렵 이 사건 각 부동산은 이미 독립한 건물로서의 실체를 갖추고 있었으므로, 위 묵시적 특약에 의하여 피고 ○○○은 이 시점에서 이미 이 사건 각 부동산에 관한 소유권을 원시취득하였다. 또한 앞서 살펴본 사정에 비추어보면, 이 사건 합의의 내용은 '준공검사를 마친 후 이 사건 각 부동산에 관하여 이 사건 공사채권자들의 대표자 2인 명의로 소유권보존등기를 마친다'는 것이어서 소유권보존등기 전에 위 대표자 2인 명의로 건축허가를 변경하는 등의 방법으로 소유권보존등기를 마쳐주겠다는 뜻으로 해석될 뿐 피고 ○○○이 이 사건 각 부동산에 관한 권리를 포기하고 이 사건 공사채권자들이 이 사건 각 부동산을 인수하여 공사주체로서 잔여공사를 한다는 취지로 보기는 어렵다. 그렇다면 이 사건 합의는 이 사건 공사가 마무리 되어 이사건 각 부동산이 완공될 경우 피고 ○○○이 이 사건 공사채권자들에 대한 공사대금채무 및 대여금채무에 대한 담보목적의 범위 내에서 이 사건 각 부동산의 소유권을 이사건 공사채권자들에게 이전하되 편의상 그 대표자 2인 명의로 소유권보존등기를 마쳐두기로 한 채권적인 담보약정에 불과하다 (가사 피고 ○○○, ○○○ 등이 이 사건 각 부동산의 신축에 관한 노력과 재료를 제공한 바가 없거나 이를 모두 포기하였고, 원고들 및 원고들에게 채권을 양도한 공사채권자들만이 이 사건 각 부동산의 신축에 관한 노력과 재료의 전부를 부담하여 건물을 완성함으로써 이를 원시취득하였다고 가정하더라도, 이 사건 공사채권자들 중 원고들을 제외한 다른 채권자들이 이 사건 각 부동산에 관한 자신들의 소유권을 원고들에게 이전하기 위하여서는 민법 제187조 단서 규정에 따라 먼저 이 사건 공사채권자들 명의로 등기하여야 하는바, 이 사건에서 이와 같은 등기를 거쳐 원고들에게 이 사건 각 부동산에 관한 소유권이 귀속되었다고 볼 증거도 없다).

Thus, the plaintiffs' assertion based on this premise is without merit without further review.

3. Conclusion

Therefore, the plaintiffs' claims against the defendants are dismissed in its entirety as it is without merit. It is so decided as per Disposition.
