1.The judgment of the first instance shall be modified as follows:

The defendant shall pay to the plaintiff KRW 14,000,000 as well as to the plaintiff on June 2015.

1. Facts of recognition;

A. On June 22, 2013, B entered into a comprehensive business automobile insurance contract (hereinafter “instant insurance contract”) with the Defendant with respect to the instant car, with the insurance period from June 22, 2013 to June 22, 2014, with respect to the instant car for which the Plaintiff driven the said car. From June 22, 2013 to June 22, 2014, with respect to self-physical accidents, the Plaintiff is the insured of the instant insurance contract for which the Plaintiff driven the said car.

B. On June 21, 2014, the Plaintiff, while driving the said car and driving it in the vicinity of the Tongdogdog-gun, Ulsan-gun, Ulsan-gun, the Plaintiff shocked Dogdog-si (hereinafter “instant accident”), and thereby, sustained the injury of the pressure frame No. 2nda. 3.

C. According to the insurance contract of this case, insurance money due to a second-hand disability (the time when the person's physical disability remains after being treated as a result of a direct result of the injury) among self-physical accidents is limited to the insurance amount by each disability grade as stated in the insurance policy according to the following "the table of the amount of insurance coverage by grade", and the disability grade shall be in accordance with the classification of the second-hand disability as specified in the Enforcement Decree of the Guarantee of Automobile Accident Compensation Act, and where there does not occur any deduction such as the amount of compensation received from a third party other than the obligor for damage (this accident does not dispute that the above deduction amount does not occur as a sole accident), the insurance amount by disability grade shall be paid by each disability grade

The amount of insurance coverage of the disability grade 15 million won, 30 million won, 5 million won, 5 million won, 5 million won, 2.1 million won, 4.2 million won, 4.2 million won, 1.4 million won, 1.4 million won, 1.5 million won, 1.5 million won, 1.5 million won, 1.5 million won, 1.3 million won, 1.8 million won, 1.6 million won, 6 million won, 1.6 million won, 1.6 million won, 4 million won, and 1.2 million won, 1.4 million won, for the classification of aftermath disabilities and the list of the purchase amount of insurance for each grade.

D. The Plaintiff’s injury constitutes Grade 1 of the Enforcement Decree of the Guarantee of Automobile Accident Compensation Act [Attachment 2] (hereinafter “the Plaintiff’s injury”), among the remaining disability ratings under the Enforcement Decree of the Guarantee of Automobile Accident Compensation Act.
