Defendant
A shall be punished by a fine for negligence of KRW 7,000,000, and by a fine of KRW 3,000,000.

Reasons
Punishment of the crime
1. Defendant A
A. On December 10, 2008, the Defendant violated the Road Traffic Act (unlicensed driving) driving the Dogwon Road without a driver’s license from 19:25 on December 10, 2008 to 19:25 on the Dogwon Road in Dog-si.
B. Around August 2013, the Defendant: (a) received a request from police officers E belonging to the Jeju Police Station for an investigation into the aforementioned unauthorized driving case; and (b) requested B to make a statement as if B driven a vehicle driven by SM3 as above at the seat of the Seoul Guro-gu Seoul F and the Defendant’s work site, around August 9, 2013, in order to escape criminal punishment by taking advantage of the fact that the said SM3 vehicle was registered as owned by B, the former workplace car, the former workplace car, and around August 9, 2013.
B, around 10:30 on September 6, 2013, at the Gocheon-dong, prepared and submitted a “traffic accident-related person’s statement” with the false content that “B was a traffic accident while driving the said SM3 car, and A was on board the back at the time,” to the slope E who is investigating the said SM3 car without a license.
As a result, the Defendant made a false statement as if he driven the above SM3 car, thereby instigating the criminal escape.
2. On September 10, 2013, upon receipt of a request from Defendant A to the same paragraph, the Defendant appeared together with A at the office of the Transport Investigation Team at the Guang Police Station, and prepared and submitted “A statement of traffic accident-related person” as if he/she driven the said SM3 car, to the police officer who is investigating the said SM3 car without obtaining a license.
Accordingly, the defendant, who committed a crime corresponding to a fine or heavier punishment, was allowed to escape.
