Defendant
A shall be punished by imprisonment for six months and by imprisonment for four months.
However, each of the above punishments for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
Defendant
A was married on February 19, 2007 with C and a person who is under the chain of victim D (Nam, 10 years of age) on April 24, 2019, and is currently pending a divorce lawsuit with C on April 24, 2019, and Defendant B is a person of Defendant A.
Defendant
From around 2016, A began with C, and C had the victim raised together with C’s parent, who is an external father-parent of the victim. Since that time, Defendant A had been able to take care of the victim at the victim’s residence under consultation with C.
On May 23, 2019, the Defendants taken out the victim's house in Incheon from the victim's house, and recruited the victim's protection supervisor C, E, and F without consultation with the victim's protection supervisor, the victim's external grandparents, and conspired in writing in the third type G apartment H H which the Defendants reside and live.
Accordingly, at around 19:48 on May 23, 2019, the Defendants were on the victim’s house in Gyeyang-gu Incheon International Apartment Co., Ltd., and at around 19:48, Defendant A went out of the victim’s outer parent E and F, as if they were to talk with the victim, and went out of the victim’s house in advance, and then boarded the victim’s vehicle; and Defendant B was on the same line with the above vehicle; Defendant B got out of the victim’s cell phone so that the victim’s cell phone can not be contacted with C, E, and F; Defendant B got off the victim’s horse until March 23, 201. The Defendants were on the same day, upon request of the victim to get contact with the police officer according to C’s abduction report and get off the victim to the nearby police station. At around 23:20, the Defendants went out of the police station at around 19:13 meters away from the victim’s house and 3:3 meters away from the victim’s seat.
As a result, the Defendants conspired with each other to capture a minor victim under the protection and rearing of her mother C, E, or F.
