1. 폭행 피고인 A는 2015. 6. 25. 15:00 경 대전 둔 산 경찰서 수사과 경제 팀 사무실에서, 피고인 A 와 남편인 B이 피해자 E(32 세 )으로부터 1억 2천만 원을 투자비 명목으로 교부 받아 편취한 사기 혐의로 피해자와 대질조사를 마치고 조서를 열람하고 있던 중, 그곳에 있던 피고인의 모 F이 피해자에게 ‘E 아 끝나고 엄마 좀 보고 가자 ’라고 하였는데 피해자가 ‘ 저 뻔뻔한 아줌마가 뭐라고 하는 거야 ’라고 말하였다는 이유로, 왼손으로 피해자의 머리를 1회 때려 폭행하였다.

2. 1. 폭행 피고인 B은 2015. 6. 25. 15:00 경 대전 둔 산 경찰서 수사과 경제 팀 사무실에서, 피고인 B과 피고인의 처 A가 피해자 E(32 세 )으로부터 1억 2천만 원을 투자비 명목으로 교부 받아 편취한 사기 혐의로 피해자와 대질조사를 마치고 조서를 열람하고 있던 중, 그곳에 있던 피고인의 장모 F이 피해자에게 ‘E 아 끝나고 엄마 좀 보고 가자 ’라고 하였는데 피해자가 ‘ 저 뻔뻔한 아줌마가 뭐라고 하는 거야 ’라고 말하였다는 이유로, 피해자에게 ‘ 씨 발 새끼, 좆만 새끼 ’라고 욕설을 하면서 ‘ 따라 나와 봐’ 라며 오른손으로 피해자의 오른쪽 어깨와 겨드랑이 부분을 때려 폭행하였다.
