Reasons
Punishment of the crime
[criminal history] On November 27, 2007, Defendant A was issued a summary order of KRW 2 million for a crime of violating the Road Traffic Act at the Gunsan Branch of the Jeonju District Court on November 27, 2007. On August 17, 2016, the same court was sentenced to the suspension of execution for 8 months due to a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) and a violation of the Road Traffic Act (drinking). The judgment became final and conclusive on the 25th day of the same month.
[Criminal facts]
1. Defendant A
A. On August 9, 2017, the Defendant driven a motor vehicle without obtaining a driver’s license in a state of alcohol concentration of about 22 km from the front side of the C apartment in Yasan-si to the front side of the E-mail located in Gunsan-si, Yasan-si around 14:20 on August 9, 2017.
B. On August 9, 2017, the Defendant issued a driver’s license in the name of the Commissioner General of the National Police Agency B in the name of the Chungcheongbuk-gu Police Agency, which is an official document and sounded in advance upon the request of H, a police officer affiliated with the G police box in the Gunsan Police Station G police station, who was dispatched to the front site of the E on the road located in the Gunsan-si, Gunssan-si, and presented a driver’s license.
