1. Basic facts

A. Conclusion and amendment of the instant construction contract 1) The Defendant concluded the E construction work in 2009 (hereinafter “instant construction work”).

(2) The Plaintiffs and F Co., Ltd. (hereinafter referred to as “Co., Ltd.” in the name of the parties are omitted) constituted a joint contractor with the representative company of Plaintiff A (hereinafter referred to as “instant joint contractor”) and participated in the instant construction tender, and the successful bidder was determined.

Since then, F withdraws from the instant joint supply and purchase organization around 2012, the ratio of shares of the instant joint supply and purchase organization was determined to be 49.48% for Plaintiff A, 24.21% for Plaintiff B, 21.05% for Plaintiff C, and 5.26% for Plaintiff D.

3) On November 19, 2010, the instant joint contractors and G, H, and I concluded an annual contract on the instant construction project with the Defendant as follows: (a) the contract amount of KRW 4,363,00,000 for the instant construction project; (b) KRW 246,840,00,000 for the total construction period; and (c) November 19, 2010 for the date of commencement; and (d) December 31, 2010 for the instant construction project; (b) the annual contract was concluded on a total of six occasions as listed below; and (c) each annual contract was concluded for the amendment to each annual construction project.
