A defendant shall be punished by imprisonment for not less than three months.

Punishment of the crime

[Criminal history] On May 11, 2017, the Defendant was sentenced to two years of imprisonment for fraud at the Seoul Central District Court, and the said judgment became final and conclusive on May 19, 2017.

[2] On August 18, 2014, the Defendant, along with C and D, purchased a vehicle with installment financing in the name of F office of the Defendant’s management company located in Gangseo-gu Seoul, Gangseo-gu, Seoul, with the intention to commit an “inception of automobile tin” in the name of a vehicle disposal lane. Accordingly, the Defendant: (a) around August 18, 2014, purchased a vehicle under the name of F office of the Defendant’s management company located in Gangseo-gu, Seoul; (b) around August 18, 2014, by using the Plaintiff’s identification card, telephone, etc. issued from C and D at the point of opening Busan, Busan, Busan, Busan, with the interest rate of 6.5% per annum, and 60 months in the installment period; and (c) obtained a loan of 3,522,000 won per month to pay for the victim’s 688,728 won per month; and (c) purchased the above 100,000.

However, the defendant, together with C and D, intended to raise funds by means of disposing of the said car borrowed from the victim company, and did not have any intent to use the said car for the victim company, and did not have any intention or ability to pay the premium normally to the victim company.

Nevertheless, the Defendant, in collusion with C and D, by deceiving the staff in charge of the victim company as above, obtained a loan of KRW 35.2 million from the victim company on the same day through the staff in charge.
