The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal (two months of imprisonment and two years of suspended execution) of the lower court is deemed to be too unhued and unfair.

2. In order to establish the legal order of the judgment state and eradicate the light of the public authority, the crime of obstruction of performance of official duties constitutes grounds for sentencing unfavorable to the defendant, including the fact that there is a need to strictly punish the defendant, the fact that the defendant was subject to a juvenile protective disposition even though he was punished for violence and drinking-related crimes, and that there are several times of records of receiving a juvenile protective disposition. However, the prosecutor's assertion is not acceptable since the defendant led to the crime of this case, and his mistake is divided in depth, the defendant agreed with the victim of the crime of obstruction of business of this case and damage of property, the defendant was detained for about one month in this case, and the defendant was living under detention for about one month, and the family members of the defendant are leading the defendant to the defendant.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
