Reasons
Punishment of the crime
In using and managing the means of access, no one shall transfer the means of access unless otherwise specifically provided for in other Acts.
1. Defendant A
A. A. From January 6, 2014, the Defendant violated the Electronic Financial Transactions Act (taking over an access medium) received, respectively, a passbook, physical card, security card, and password, which is a means of access under B’s name, by paying KRW 100,000 to Namyang-si, J, 108 Dong 403, and B, and by taking over the passbook, physical card, security card, and password, which is a means of access under B’s name (K) from that time to June 2, 2015, as shown in the Attached Crime List (1) as above, seven times in total, including the passbook, physical card, security card, and password.

2. Around January 6, 2014, Defendant B heard that “I will give KRW 500,000 to a month if I lend the passbook” from the Namyang-si, J, 108 Dong 403, and Defendant B transferred the passbook, e-mail card, security card, and password, which are the means of access to a new bank account (K) that can be deposited and withdrawn under the name of the Defendant, to A after receiving KRW 1 million.
3. Around January 15, 2014, Defendant G heard that “If a passbook is created, the Defendant would give KRW 500,000 to one month” from Gwangju Northern-gu M and B 305, and Defendant G received the passbook, check-up card, security card, and password, which are the means of access to and withdrawal from the Defendant’s account (N:N) and then sent it to A, instead of KRW 1 million.
