1. The Defendants shall jointly and severally pay to the Plaintiff KRW 250 million and the interest rate from September 25, 2015 to the day of full payment.

On September 29, 2011, the Plaintiff leased KRW 250 million to Defendant B with the due date set as December 15, 2011, and Defendant C Co., Ltd guaranteed Defendant B’s above loan obligation on the same day.

Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff the above borrowed amount of KRW 250 million and damages for delay calculated at the rate of 20% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from September 25, 2015 to the date of full payment, as sought by the Plaintiff, after the day following the above repayment period.

[3] Article 208(3)3 of the Civil Procedure Act provides that “The Defendant shall be notified of the date by public notice pursuant to Articles 194 through 196 of the Civil Procedure Act and did not appear on the date of pleading.”
