Reasons
1. Basic facts
A. D Co., Ltd. (hereinafter “instant company”) established a company E by inviting salespersons and inviting them to receive investment money through multi-level sales method. However, the instant company was practically impossible to pay monthly salary as actually promised to the higher class and its members, as it does not have profit structure and only makes investment money paid in the course of joining the lower sales organization.
B. In introducing the instant company to the Plaintiff, the Defendant, who served as the head of the department and the head of the Gangnam branch of the instant company, was to pay wages to the Plaintiff according to the “re-designated employee benefit franchise” if he/she has subscribed to the instant company as a member of the company, 4 million won has been paid, 1.2 million won has been paid, and 3.6 million won has been paid monthly salary for three months each month, and 4.4 million won has been paid in total by 8 million won in the 4th month. In addition, according to the number of the members of the Newly recruited company, 200,000 won has been paid to the Plaintiff, and 3.4 million won has been increased by 80,000 won in total. B, the husband, the vice head, the head of the team, the head of the division, the head of the division, and the head of the headquarters, etc. should be promoted to the head of the instant company, and 3.00 won has been recommended as the vice head of the instant company.
C. On March 2, 2015, the Plaintiff trusted the Defendant’s horse and transferred KRW 3.8 million to the deposit account (F of a national bank) of the instant company designated by the Defendant as the membership fee. On March 18, 2015, the Plaintiff transferred KRW 4 million to the deposit account (G of a national bank) in the name of the Defendant, etc. from March 2, 2015 to the same year.
