A. The Plaintiff is the owner of each land (hereinafter collectively referred to as “instant land”) E, F, and G (hereinafter collectively referred to as “the instant land”) in Haan-gun, Gyeongnam-gun, Haan-gun, and the Plaintiff cultivated fruit trees from the instant land No. 1.

The Defendants are co-owners of each real estate indicated in the separate sheet (hereinafter “instant land No. 2”) adjoining to the instant land No. 1.

나. 원고는 과거 H, I, J 각 토지에 난 샛길을 이용하여 공로(K 도로)로부터 이 사건 제1 토지에 출입하였다.

그런데 피고들이 그 소유인 J 토지 위에 주택과 축대를 건축함으로써 위 샛길은 막히게 되었고, 현재 비탈진 언덕만 남아 차량은 물론 도보로도 통행이 곤란한 상태이다.

According to the above findings of determination, it is highly probable to view that the Plaintiff is unable to enter a public road without passing through the land subject to confirmation, such as having to go through mountain or pass through a third party’s land in order to reach the land of this case from the public road, or having to have access to a public road without passing through the land subject to confirmation, or having failed to perform sufficient functions as an actual passage, or having excessive cost of entering a public road.

However, the width, location, method of passage, etc. of the passage route should be the lowest damage to the owner of the right of passage, and the plaintiff at the end of the week of this case.
