Punishment of the crime
【The Defendant was sentenced to a suspended sentence of two years for criminal fraud at the Incheon District Court on October 16, 2014, and the said judgment became final and conclusive on May 4, 2016.
[Criminal Facts]
1. Embezzlement;
A. On March 30, 2015, the Defendant entered into a lease agreement with the Defendant on the EWs CS350 vehicles in the name of a type D, on the condition that the Defendant would pay KRW 1,543,930 per month between 48 months and 48 months. From the above day, the Defendant acquired and operated the said benz CS350 vehicle from around March.
On March 30, 2015, while the Defendant kept the said vehicle for the victim, the Defendant borrowed 10 million won from F in front of the 107 and the 1,00 million Won from F in front of the Gyeongcheon-si Park, as it was around 19:33 on March 30, 2015, and provided the said vehicle as security at will.
Accordingly, the defendant embezzled the victim's property.
B. On October 21, 2015, the Defendant entered into a lease agreement with Korea for social services of halogen halogen (State) around September 24, 2015 on the condition that “payment of KRW 1,653,322 per month between 60 months” and “a payment of KRW 1,653,322 per month between 60 months,” and operated the said A7 vehicle from around the said day.
On October 21, 2015, the Defendant: (a) borrowed KRW 15750,000 from H in front of the 10:55,00,000,000 from the Nam-gu, Nam-gu, Incheon, Seoul, the Defendant, while keeping the said vehicle for the victim; (b) provided the said Dou A7 vehicle as security at will.
Accordingly, the defendant embezzled the victim's property.
2. Larceny;
A. On April 9, 2015, the Defendant: (a) provided the Victim F with the E Benz ls350 vehicle as security; (b) on April 9, 2015, the Defendant was parked in the 717 official Han fluor apartment parking lot as the Incheon Southern-gu Gyeongwon around 08:00 on April 9, 2015; (c) was driving by walking the said vehicle at a reserve key; (d) was in excess of 60 million won at the market price occupied by the Victim F; and (e) was in excess of 350.350.
