A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 도로교통법위반(음주측정거부) 피고인은 2016. 5. 15. 03:30경 속초시 C에 있는 D편의점 앞길에서 술 냄새가 나고 얼굴에 홍조를 띠며 보행상태가 매우 비틀거리고 횡설수설하는 등 술에 취한 상태에서 E 티볼리 에어 승용차를 운전하였다고 인정할 만한 상당한 이유가 있어 속초경찰서 F지구대 소속 경사 G, 순경 H으로부터 같은 날 03:54경부터 04:18경까지 3회에 걸쳐 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구받았음에도 불구하고 입김을 불어 넣는 시늉만하는 등 정당한 사유 없이 경찰관의 음주측정요구에 응하지 아니하였다.

2. 공무집행방해 피고인은 2016. 5. 15. 04:20경 속초시 I에 있는 속초경찰서 F지구대에서 전항 기재와 같이 음주 측정을 요구받자 “씨발 좃같네. 경찰 씹새끼들. 또라이 같은 새끼들. 이 따위 밖에 못해 개새끼들아. 씨발 변호사 부를 꺼야 아무것도 하지마. 씹새끼들아.”라고 욕설을 하며 출입문을 열고 도주하려고 하여 위 지구대 소속 순경 J(여, 30세)이 이를 제지하자 "야 씨발년아."라고 욕설을 하면서 피고인의 오른손 주먹으로 순경 J의 코를 1회 때린 후 주차장 쪽으로 도주하였고, 이에 위 지구대 소속 순경 H(24세)이 뒤쫓아가 이를 제지하자 피고인의 발로 순경 H의 얼굴을 1회 걷어차 순경 J 및 순경 H을 각각 폭행하였다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the suppression and investigation of police officers' crimes, public peace and order maintenance.
