The judgment of the court below (including the part not guilty in the grounds) shall be reversed.

The defendant is innocent. The summary of this judgment shall be notified publicly.

1. Progression of litigation and scope of adjudication;

A. The prosecutor indicted the Defendant on the Internet newspaper “C” website for the purpose of slandering the victim, and on April 2004, by committing an indecent act against the victim, the victim committed an indecent act against the victim, while serving as the construction of the F Embassy of Korea (hereinafter “F Embassy”) and serving as the construction of the F Embassy of Korea (hereinafter “F Embassy”), resulting in female employees and cans, booming female employees’ body, and booming sexual indecent act (hereinafter “instant notice”), and committing an indecent act against multiple women, thereby spreading false facts via the information and communications network, thereby impairing the victim’s reputation.

B. The court below found the Defendant guilty on the part of the notice of this case that “the victim caused female employees and cans while serving in the office of the F Embassy, boomed female employees’ body, and fluent sexual harassments, etc., and sentenced the Defendant to a fine of KRW 1,50,00,00 on the ground that there is insufficient proof of crime regarding the part that “the victim committed sexual harassment against female women around April 2004,” as to “the part that “the victim committed sexual harassment against female women,” was not guilty of the reasoning.

Therefore, the defendant appealed against the guilty portion on the ground of mistake of facts and misapprehension of legal principles.

C. The judgment of the court prior to the remanding of the case ordered the conclusion of the judgment of the court below on the part of "not guilty in the grounds" of the judgment below, and the part of the judgment of the court below on the part of the notice of this case concerning "the injured party caused many women who work in the office of the F Embassy as the construction of the F Embassy" as to "the injured party caused female employees and cans while serving in the F Embassy, interfered with the body of female employees, and caused sexual harassment," the judgment of the court below is reversed, and the judgment of the court below is reversed, and the defendant was sentenced to a fine of 50,000 won."

Accordingly, the Defendant appealed against the guilty portion on the grounds of misapprehending the legal principles.
