The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

B. The lower court’s sentence of unreasonable sentencing (a fine of KRW 700,000) is excessively unreasonable.

2. Determination

A. According to the evidence duly adopted and examined by the court below regarding the assertion of mistake of facts, the victim has consistently stated the circumstances of the case from the investigative agency to the court of the court below, the facts of damage, and the part of the injury, etc., and supported the victim's statement even though the witness G's statement, the photograph of the personal floor and the part of the victim's injury immediately after the case, and the victim's photograph and injury diagnosis, and no other circumstance exists to suspect the credibility of the victim's or witness's statement

Therefore, since the facts charged in this case is sufficiently convicted, there is no illegality of mistake of facts in the judgment of the court below.

B. Comprehensively taking account of the background and content of the crime on the assertion of unfair sentencing, the degree of damage, and the fact that the nature of the crime has not been mitigated in light of the circumstances of the crime in this case, the damage caused by the crime in this case has not been recovered, and other various sentencing conditions indicated in the records and arguments, including the defendant’s age, character and conduct, environment, and circumstances after the crime

Even if the sentence of the court below is too unreasonable, it cannot be deemed that the sentence of the court below is too unreasonable.

3. As such, the defendant's appeal is without merit, and it is dismissed under Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
