Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 12, 2017, the Defendant, at around 19:00, sent singing in the “F” that was known through usual mobile hosting in Seongbuk-gu, Seongbuk-gu, Sungnam-si, Sungnam-si, and the “D” that was near the drinking, followed by the Defendant’s singing in around 23:30 on the same day. The Defendant, around 23:30 on the same day, went back to the Helto G located in Sung-gu, Sungnam-gu, Sungnam-gu., 501 on the same day.

1. Around August 12, 2017, the Defendant: (a) had been drunk at the Hel 501 heading room around 23:30 on August 12, 2017; (b) had been drunked to rape the victim; (c) had kising the victim on the part of the victim; and (d) had the chestd.

Accordingly, it is called that the victim who has a mind is not the victim.

As a result, the defendant raped a female victim, and thereby, caused the victim to suffer bodily injury, such as influence of head in need of treatment for about two weeks.

2. At around 07:00 on August 13, 2017, the Defendant: (a) laid down the body of the victim in a situation where resistance is impossible due to the crime of paragraph (1) in the said Hel 501 heading room on the part of August 13, 2017; and (b) licking the bridge at any time.

“The victim had sexual intercourse once by inserting the Defendant’s sexual organ into the part of the victim’s sexual organ after coercioning the victim’s bridge by force.”

3. While the Defendant was assaulted to engage in sexual intercourse with the victim at the time, time, and place described in paragraph 1 at the same time and place, the victim discontinueds resistance and crepits used in the room floor of the victim, resulting in theft by taking cash 10,000 won from the victim’s wall and one thousand won right from the victim’s wall.
