피고인은 2015. 8. 5. 10:00 경 부산 금정구 중앙대로 2238( 노포동 )에 있는 고속버스 종합버스 터미널에서, 2 층 매표소에서 에스컬레이터에 타고 1 층 승 차장으로 내려가던 중 옆에 세워 놓은 여행용 캐리 어가 뒤로 넘어졌을 때 피고인 뒤에서 서 있던 피해자 B( 남, 59세) 가 발로 캐리어를 밀어냈다는 이유로 말다툼을 하다가 왼손 손바닥으로 빰을 1회 때려 폭행하였다.
