A defendant shall be punished by a fine of 500,000 won.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

From December 16, 2015 to May 3, 2016, the Defendant was a person who was a person in charge of accounting related to the political funds and election expenses of L candidates belonging to the 20th National Assembly member election commission.

Where an election campaign is commenced only from the commencement date of the election period to the day preceding the election day, and where text messages are sent at a time other than the election day, those who are permitted to send such messages by means of automatic broadcast communications utilizing computers and computer-based technologies shall be limited to candidates and preliminary candidates, but the number of times such messages may be sent shall not exceed five times.

On December 16, 2015, the Defendant: (a) registered as a person in charge of accounting of political funds and election campaign workers of L preliminary candidates; (b) obtained from M, a person in charge of accounting of L’s supporters’ association, the ID and password of the account opened in M in the name of M from M, the company sending large amounts of text messages; and (c) received them from M, a person in charge of accounting of L’s supporters’ association, using the said N, with intent to send the word “O” and passwords by means of automatic broadcast communications.

On January 22, 2016, around 11:28:30 on January 22, 2016, the Defendant had access to the said M M’s N account using a computer located at the election office of L preliminary candidates located in Seoul P 3rd floor, and transmitted the following letters to 63 reception numbers, including Q, in the name of L preliminary candidates:
