On May 28, 2018, the Defendant, at around 18:00, taken a photograph of the Defendant’s cell phone with an analysis sheet in which the document stating a candidate’s separate support rate confirmed through the said three-time public opinion poll was located on a book, at around 18:00, the Defendant discovered that the document was on a book.
On May 29, 2018, the Defendant, at around 07:30 on May 29, 201, was well aware of the fact that he was “J” at around 07:30.
In the Do, "I see the results of the public opinion poll of the B/Gun candidate" in the Do with K.
“.......” The photograph taken above to K shall be shown, and shall be sent from the above K at the defendant’s office located in L on the same day, only one of the photograph taken.
The Constitution of the Republic of Korea received the call and sent the above photograph to K via M, and on the same day, K sent the above photograph to N, N from May 29, 2018 to May 30, 2018 to N, and P transmitted the above photograph to P in sequence.
Accordingly, the Defendant published the results of the public opinion poll on the election conducted by the candidate before the voting closing time on June 13, 2018, which is the election day.
