1. Basic facts

A. 1) The details of the change in ownership of each real estate of this case ) M are each real estate listed in the separate sheet on December 29, 1995 (hereinafter “each real estate of this case”).

On November 24, 1995, N,O, P, Q, and R (hereinafter “N, etc.”) completed the registration of ownership transfer based on inheritance by consultation and division. (2) N, P, Q, and R (hereinafter “five persons”) completed the registration of ownership transfer or co-ownership ownership transfer based on sale of each of the instant real estate from August 24, 2007 to August 29, 2007.

3) The Plaintiffs asserted that one-half shares of each of the instant real estate were owned by the father of the Plaintiff, and filed a lawsuit against five persons including N, etc. on December 12, 2007, the Gwangju District Court rendered a judgment in favor of the Plaintiff on August 14, 2009 on the ground that the registration of ownership transfer of one-half shares of each of the instant real estate and the registration of ownership transfer or co-ownership transfer of five persons including N based on N, etc. are null and void. The said judgment became final and conclusive on December 10, 2010. 4) On July 20, 2012, the Plaintiffs completed the registration of ownership transfer for one-half shares of each of the instant real estate (the Plaintiffs each share of 1/2 shares and 1/16 shares each of the instant real estate, collectively, and all of the Plaintiffs’ shares owned by the Plaintiffs).

5) Meanwhile, from five persons, K acquired ownership of each of the real estate listed in Articles 10 through 17 of the separate sheet among the instant real estate from N, etc. As between August 9, 2013 and September 16, 2013, the Defendant acquired the ownership of each of the instant real estate, and the remainder of the shares (hereinafter “instant Defendant’s share”).
