The defendant's appeal is dismissed.

1. The decision of the court below on the summary of the grounds for appeal (the fine of 3.5 million won) is too unreasonable.

2. The judgment of the court below is based on all other circumstances, including the defendant's age, character and conduct, environment, family relationship, motive and circumstance of the crime, and circumstances after the crime, etc., that the sentence of the court below is too too unreasonable, and thus, is not recognized to be unfair, considering the following factors: (a) the blood alcohol concentration at the time of the instant case is higher than 0.157%; (b) the court below appears to have reduced the fine amount on the summary order (4 million won) by fully considering the circumstances favorable to the defendant; and (c) considering all other circumstances, such as the defendant's age, character and behavior, environment, family relationship, motive and circumstance of the crime, etc., the sentence of the court below is too unreasonable.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
