1. On the Plaintiff (Counterclaim Defendant),

A. Defendant (Counterclaim Plaintiff) B is 21,784,748 won, Defendant C is 3,468,263 won and each of the said money.

The main lawsuit and counterclaim are also examined.

1. Facts of recognition;

A. On June 20, 2012, E Co., Ltd. (hereinafter “E”) with the owner of the building indicated in the attached Form (hereinafter “the instant building”) entered into a lease agreement (hereinafter “the instant lease agreement”) with F Co., Ltd. (G Co., Ltd.; hereinafter “F”) around June 20, 2012, with the term “E” (hereinafter “E”) stating that deposit KRW 20 million among the instant building, the underground room, the first floor and the second floor are KRW 1.65 million among the instant buildings, monthly rent (including value-added tax), and the term of lease from August 15, 2012 to August 15, 2014.

After that, the term of lease was extended by August 15, 2016.

B. Around May 22, 2013, F entered into a sublease contract with H Co., Ltd. (hereinafter “H”) and with the owner of the leased object (hereinafter “instant store”) on the condition that the said leased object is sub-leaseed with a deposit of KRW 3 million, monthly rent of KRW 50,000,000 (including value-added tax), and the sublease period from May 22, 2013 to May 21, 2015 (hereinafter “sub-lease contract in this case”).

C. After that, with the consent of E on June 16, 2014, I succeeded to the former lessee’s status under the instant sub-lease contract and operated the car page in the name of “J” at the instant store.

The Plaintiff purchased the instant building from E on April 18, 2015 and completed the registration of ownership transfer on June 24, 2015.

E. On July 10, 2015, the Plaintiff and F agreed on the instant lease agreement, and on the same day, the Plaintiff returned 1,2850,000 won remaining after deducting the overdue rent from 20 million won to 10,015 to 20 million won.

F. From August 1, 2015, Defendant B operated the car page with the trade name “K” on the underground floor of the instant building and the first floor, and delivered it to the Plaintiff on November 24, 2017.

G. Of the instant building, the rent for “15 square meters on the underground floor” is 50,000 won per month (including surtax) and the rent for the part occupied by the said Defendant on the first floor is 150,000 won.
