The prosecutor's appeal is dismissed.
Reasons
1. A person who has suffered damage to the gist of reasons for appeal has committed an indecent act several times against the defendant at the investigative agency and the court of original instance;
In light of the following: (a) the Defendant and the victim made a statement on February 13, 2016; (b) the Defendant and the victim made a call on February 13, 2016; and (c) the Defendant and the victim have repeatedly made a defect in the matters at the time of the Defendant and made a apology to the victim, the Defendant and the victim may be found guilty of the charges
Nevertheless, since the court below denied the credibility of the victim's statement and rendered not guilty of the facts charged in this case, the court below erred by misapprehending the facts.
2. Determination
A. In light of the following circumstances, the lower court rendered a judgment that acquitted the Defendant of the instant facts charged on the ground that the evidence directly supporting the facts charged could not only have the victim’s statement in the instant case where the victim’s statement was the sole victim’s statement. Therefore, the lower court acquitted the Defendant of the instant facts charged.
1) ① When the victim first makes a statement at an investigative agency, the victim : (a) driven the Defendant on an expressway without any sound as the Defendant sent a fake and buckbucks to the expressway; and (b) whether the chest was a tank in the vicinity of the D apartment; and
The Defendant stated that kisk and kisk caused the left chest and left bucks, and that the kisk could not be cut off.
