A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

On October 13, 2006, the Defendant was sentenced to a summary order of a fine of three million won for a violation of the Road Traffic Act (driving), etc. at the Daejeon District Court on November 13, 2006. On November 21, 2006, the Defendant was sentenced to a suspended sentence of two years for a violation of the Road Traffic Act (driving) at the Chungcheong District Court on November 21, 2006. On November 26, 2015, the Defendant was sentenced to a suspended sentence of two years for a violation of the Road Traffic Act (driving). On December 4, 2015, the Defendant was sentenced to a suspended sentence of two years for a violation of the Road Traffic Act (driving).

1. On November 10, 2016, the Defendant was driving a two-wheeled vehicle of about 1.5 meters in the section of approximately 1.5 meters of alcohol while under the influence of alcohol for 0.215% of alcohol while under the influence of alcohol without obtaining a motor device license from Daejeon-dong, Daejeon-gu, Daejeon-ro, Daejeon-ro 450 to the road in front of the Daejeon Jung-gu, Daejeon-ro 82.5 meters of alcohol.

Accordingly, the Defendant, who violated the prohibition of driving at least twice under the influence of alcohol, was driving the two-wheeled automobile under the influence of alcohol again.

2. The Defendant violated the Guarantee of Automobile Compensation Act: (a) was a person who owns a two-wheeled automobile as set forth in paragraph (1); (b) operated a two-wheeled automobile as set forth in paragraph (1) at the time and place set forth in paragraph (1).
