[2014 Highest 1515] - Defendant A entered into a check contract with the Defendant from November 14, 2012 at an interesting point in Han Bank, and traded household checks.

around January 20, 2014, the Defendant issued one check number “G”, “3,00,000 won”, “1 copy of the household check in the name of the Defendant,” and “the date of issuance” under the name of the Defendant, and presented it to the said bank on or around February 18, 2014 during the period for presentation, but did not receive a disposition of suspension of transaction. The Defendant issued one check in the name of the Defendant, “G”, “C”, “3,000,000 won”, and “the date of issuance, February 18, 2014” under the same location, and presented one copy of the bank check in the name of the Defendant, “C”, “C”, “3,000,000 won,” and paid it to the said bank on or around February 18, 2014 during the period for presentation, but did not receive a disposition of suspension of transaction.

1. To use false or forged securities;

A. On November 14, 2012, at the F office operated by the Defendant in Geumcheon-gu Seoul Metropolitan Government, the Defendant arbitrarily stamped the endorsement in the column for endorsement of the said check in order to raise the security of the check at a discount by raising the check number of 00028690, par value 57,500,000 of the check issued by MM E, and used the endorsement in the name of J company, which is a statement on the rights and obligations of the securities, for the purpose of exercising the said check, by forging the endorsement in the name of J company, which is a statement on the rights and obligations of the securities, and on the same day, presented the check with a forged check number to M who is aware of the forgery at the house of Guro-gu Seoul Metropolitan Government, as above.

B. On August 26, 2013, the Defendant: (a) around August 26, 2013, at the F Office operated by the Defendant in Geumcheon-gu, Geumcheon-gu, Seoul, the Defendant: (b) stamped the name plate of the KMO on the column for endorsement of the said check in order to obtain a discount by raising the collateral of the check number 00792795, par value 48,000,000 of the check; and (c) stamped the O’s seal on the next page; and (d) affixed the O’s seal thereon.
