The defendant is composed of representatives by buildings of P Apartment, which is multi-family housing with not less than 500 households located in Suwon-si Q (hereinafter "the apartment of this case"), and the plaintiffs are representatives by buildings of this case. The 16th representatives by buildings of this case.
B. On June 21, 2012, the Defendant passed a resolution to conduct waterproof and painting of the outer wall of the instant apartment (hereinafter “instant construction”) and on August 21, 2012, the Defendant selected a business entity who will perform the instant construction through a limited competitive bidding method, but at least KRW 853,560,00 (excluding value-added tax; hereinafter the same shall apply) less the estimated amount in a written estimate from KRW 853,560,00, less than KRW 626,760,00, which was a minimum price sealed bid, and then decided to select a business entity who will perform the instant construction as a business entity, and announced a public announcement of tender on August 23, 2012.
C. On October 16, 2012, the Defendant decided to change the qualification for participation in bidding from 1 billion won or more to 1.2 billion won or more as of the date of public announcement. The above resolution was adopted with the consent of only six representatives among 14 representatives present at each Dong, but the number of representatives to participate in bidding on October 17, 2012 is below the quorum.
