A defendant shall be punished by a fine of 500,000 won.

If the defendant does not pay the above fine, the amount of KRW 100,000 shall be paid.

Reasons

Punishment of the crime

The defendant is an employer who is operating a retail business with three full-time workers in the trade name called C in Busan-gu B.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and all other money or valuables within 14 days after the cause for such payment occurred;

Provided, That the date may be extended by an agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay 41,200 won of the wage balance in March 4, 2018 to March 7, 2018 at the said workplace without any agreement between the parties on the extension of the payment deadline, without having reached an agreement between the parties.

2. An employer shall pay workers subject to the minimum wage at least the minimum wage determined and publicly notified each year by the Minister of Labor, and shall pay wages at least 7,530 won per hour during the period from January 1, 2018 to December 31, 2018;

Nevertheless, the defendant paid the same worker the wage in March 2018 and paid it below the minimum wage.

3. When an employer intends to dismiss a worker, he shall do so at least thirty days prior to the dismissal, and when he fails to do so prior to thirty days, he shall pay the ordinary wages for thirty days or more; and

Nevertheless, the defendant did not pay KRW 1,807,200 corresponding to the 30-day ordinary wage as of March 7, 2018 without prior notice of the same worker.

4. An employer shall specify wages, prescribed working hours, holidays under Article 55, annual paid leaves under Article 60, and other working conditions prescribed by Presidential Decree in concluding a worker's contract, and shall also specify the constituent items, calculation method, and payment method of wages, prescribed working hours, prescribed working hours under Article 55, and Article 60.
