All judgment of the court below shall be reversed.
Defendants shall be punished by imprisonment for four years.
Reasons
Summary of Grounds for Appeal
A. Defendant A1) misunderstanding of facts (as to the third judgment of the court below), the Defendant did not either participate in receiving the deposit for lease from the victims or conspired to commit a crime with B, and the judgment of the court below which found the Defendant guilty of this part of the facts charged was erroneous by misunderstanding the facts and adversely affecting the conclusion of the judgment. Even if the judgment of the court below is not so, the judgment of the court below is unreasonable.
B. Defendant B1) misunderstanding of facts (as to the judgment of the court below of the third instance), the Defendant did not have the intent to obtain the registration of reduction of the maximum debt amount by partially repaying the secured debt to the victims, and did not have the intent to obtain the registration of reduction of the maximum debt amount. The judgment of the court below which found the Defendant guilty of this part of the facts charged is erroneous by misapprehending the facts and affecting the conclusion of the judgment. 2) Even if not, the judgment of the court below is not so unfair sentencing, each punishment (the judgment of the court below 1: two years, imprisonment of 10 months, and imprisonment of 3 years: imprisonment of 3
Judgment
A. Prior to the judgment on the grounds for appeal by the Defendants ex officio, the first, second, and third court rendered a judgment after examining each of the above decisions against the Defendants, and the Defendants filed an appeal against each of the above decisions, and the court rendered a decision to concurrently deliberate on each of the above appeals cases. The crimes of the first, second, and third court in relation to the Defendants are concurrent crimes under the former part of Article 37 of the Criminal Act, and shall be sentenced to a single sentence within the scope of the term of punishment subject to aggravated concurrent crimes under Article 38(1) of the Criminal Act. In this regard, the judgment of the court below against the Defendants was all reversed.
