Reasons

1. Facts of recognition;

A. The Plaintiff is a housing redevelopment and consolidation project association, which is the project implementer of the “A Housing Redevelopment and Rearrangement Project” (hereinafter “instant project”), whose business area covers 125,59.9m2 of the Michuhol-gu Incheon Metropolitan City K members.

B. Around May 2010, the Mayor of Incheon Metropolitan City issued the designation of an urban renewal acceleration district and the designation of an urban renewal acceleration district with respect to the instant project area. On February 20, 2012, the Mayor revoked the designation of an urban renewal acceleration district with respect to the instant project area on the grounds that the instant project area was designated as an urban renewal acceleration district under the 2020 Incheon Metropolitan City Urban Residential Environment Improvement Plan.

C. On August 8, 2016, the head of Michuhol-gu Incheon Metropolitan City authorizing the instant project by setting the implementation period as 50 months from the date of authorization to implement the project, and publicly notifying it on the same day.

The head of Michuhol-gu Incheon Metropolitan City shall approve the management and disposal plan of the project in this case on June 19, 2017, and publicly notify it on the same day.

E. Defendant B’s possession of the real estate listed in the separate sheet No. 3 (hereinafter “the instant building”), Defendant C, the instant building, Defendant D’s building, Defendant F’s building, Defendant F’s building, Defendant G’s building, and Defendant H’s owner of the instant building No. 9, and the instant building No. 10, respectively. (Defendant H is the owner of the instant building No. 10 of the instant building)

Each building of this case is located within the business area of this case.

F. On November 8, 2016, the Plaintiff publicly announced that members, such as land or building owners within the relevant project zone, should file an application for parcelling-out and report on rights, from November 14, 2016 to December 18, 2016, and publicly announced that the period for filing applications for parcelling-out from December 16, 2016 to December 31, 2016 shall be extended from December 19, 2016 to December 31, 2016.

G. Defendant B: (a) December 12, 2016; (b) December 13, 2016; and (c) December 13, 2016; and (d) Defendant D, respectively.
