A defendant shall be punished by imprisonment for not less than two years and six months.

To order the defendant to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

1. 간음유인 피고인은 2013. 4. 8. 13:19경 성남시 중원구 C빌라 202호 피고인의 집에서 피고인이 네이버 인터넷 카페에 올린 “동거녀, 집안일 해 줄 하녀, 야한 암캐녀 구함”이라는 글을 보고 연락한 피해자 D(여, 15세)과 스마트폰으로 채팅을 하던 중 피해자를 간음할 목적으로 “사진 찍어서 보내줘. 너의 독립하고자하는 마음이 진짜인지 확인한 후에 결정할꼐”, “얼굴 팬티 보지 똥꼬 이렇게 4개만 정말로 노예로서의 암캐성향이면 주인말에 절대복종하는 것을 보여주고 또 스스로의 결심이 확고하다는 것을 증명하면 되”라는 내용의 문자를 보내 피해자를 피고인의 주거지 인근 공원으로 오게 한 후, 피해자에게 피고인의 집에서 잠을 재워주고 앞으로 같이 살겠다고 이야기하여 피해자를 피고인의 위 주거지로 데리고 갔다.

Accordingly, the defendant induced the victim for the purpose of sexual intercourse.

2. The Defendant committed a violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (compacting with the disabled) by putting the victim’s cell phone in a depository located in the Defendant’s home, and putting the aforementioned cell phone and the victim’s belongings in a depository located in the Defendant’s home in order to avoid location tracking after taking the victim’s DNA into the house, thereby causing the victim to be unable to return to the home or to seek help from another person.

At around 02:00 on April 9, 2013, the Defendant was exempted from the clothes of the above victim, who was divingd at the place specified in the preceding paragraph, and was frightened with the victim’s negative part, brupted with the victim’s fingers, and cut down the victim’s conspiracy with the face.

As a result, the Defendant committed indecent act against the disabled child or juvenile victim.

B. At around 22:00 on April 11, 2013, the Defendant: (a) laid off the victim at the above place; (b) laid off the clothes; (c) laid off the garments in hand; and (d) laid down the finger on the sound part.
