Plaintiff
The company is a company aimed at the manufacture, sale, establishment, service business, etc. of optical communications, optical fibers, measuring instruments, optical parts, and the plaintiff B is the representative of the plaintiff company.
The Defendant is the head of an institution specialized in the technological promotion of small and medium enterprises designated by the Administrator of the Small and Medium Business Administration pursuant to Article 7 of the former Act on the Promotion of Technology Innovation of Small and Medium Enterprises (amended by Act No. 14683, Mar. 21, 2017; hereinafter “former Act on the Innovation of Small and Medium Enterprises”), and is entrusted with the authority to perform affairs related to the technological innovation promotion and disposal thereof pursuant to Article 29(1) of the former Act and
Plaintiff
On June 2013, the Company entered into an agreement on the Korea Evaluation Institute of Industrial Technology and the Technology Development Project for Small and Medium Enterprises (hereinafter “instant agreement”) and the agreement on the joint development project between the Defendant and the small and medium enterprise (hereinafter “instant agreement”) respectively. The main contents of the agreement are as follows:
(1) The Plaintiff Company’s task to be performed under the instant 1 agreement refers to the title of the instant 1 project: The instant 2 (the title of the project under the instant 2 agreement): June 20, 2013 to June 19, 2015, total project cost (total 24 months) divided into cash-based Government contributions (unit : 0,000 to September 40, 2016; 30,600, 100, 1300, 600, 600, 133, 600, and 600: 10,000 project cost of the instant 20,000 project cost of the instant 20,000 project cost of the technology development project: 30,000,000 project cost of the instant 30,000,000 won and 15,000,000,000 won-based project cost of the instant 20,5,015,015,06,00.
