At the same time, the Defendant succeeds to the Plaintiff at the same time as receiving the attached property from the Plaintiff.

According to the overall purport of evidence No. 1-4 and evidence No. 1-3, the Plaintiff entered into a lease contract with respect to the real estate stated in B and the separate sheet (hereinafter “instant real estate”) by setting the lease deposit amount of KRW 120,000,000, and the lease term from March 4, 2017 to March 3, 2019; B died on February 9, 2020; D, a heir of B, died on February 9, 2020; and D, a heir of B, filed a report with the court on the renunciation of inheritance (as Incheon Family Court, 2020Hun-Ba698); and C, the other inheritor, filed a report with the court on the approval of succession (as Incheon Family Court, 2020Hun-Ba1065); and received each of the above reports by the said court.

According to the above facts, since the above lease contract was terminated on March 4, 2019, the term of lease expires, the defendant is obligated to pay 120,000,000 won to the plaintiff within the scope of the property inherited from the deceased B at the same time as the property is transferred from the plaintiff to the plaintiff.

Therefore, it is so decided as per Disposition.
