Defendant shall be punished by imprisonment for a term of one year and six months.

However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In the Daegu District Court on September 26, 201, the Defendant was sentenced to a summary order of KRW 1,50,000 to a fine for a violation of the Road Traffic Act on September 26, 201, and a summary order of KRW 5 million to a fine for a violation of the Road Traffic Act on January 15, 2014, and the Defendant was sentenced to a suspended sentence of KRW 6 months for a violation of the Road Traffic Act on June 15, 201.

방 앞 도로부터 C빌딩 앞 도로까지 약 40m 구간에서 자동차운전면허를 받지 아니하고 D 포터 화물차를 운전하다가 음주단속 중인 경찰관을 보고 위 화물차를 정차한 후 전조등을 껐고, 이를 목격한 동부경찰서 E 소속 경위 F 피의자 적발보고 등 증거기록과 대조하면, 공소장에 기재된 음주측정 요구 경찰관의 이름은 오기임이 명백하여 이를 직권으로 정정함 에게 피고인이 “황천길이 목적지”라고 하는 등 횡설수설하며 얼굴에 홍조를 띄는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어, 경위 F로부터 같은 날 01:36경부터 약 20분간 총 3회에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았다.

Nevertheless, the defendant's "I want to get off from now's place and wife suffering from cancer. I would like to live in prison," and avoided this, and failed to comply with a police officer's request for a drinking test without any justifiable reason, thereby violating the provision on prohibition of drinking under the Road Traffic Act not less than twice.
