1. 피고인들의 업무방해 피고인들은 2019. 11. 16. 21:33경 위 주점에서 계산을 요구하는 피해자에게 술값이 비싸다고 항의하던 중, 피고인 A은 피해자에게 “이 시발년, 좆 같은 년이네. 에이 개 좆 같은 년아 술값 못 줘”라고 욕설을 하고 주먹을 들어 피해자를 때릴 듯한 행동을 수 회 하다가 피해자의 머리를 1회 때리고, 피고인 B는 계산을 하지 않고 주점 밖으로 나가는 피고인들을 뒤쫓아 온 피해자에게 “야 씨발년아 얼마여”라고 욕설을 한 후 손바닥으로 피해자의 뺨을 1회 때렸으며, 112 신고를 받고 출동한 경찰이 주점 1층 앞에 도착하자 피해자에게 “야 씨발 개 좇같은 년아 짭새 새끼는 누가 불렀냐”라고 욕설을 하고 경찰이 보고 있는 앞에서 “내가 이렇게 때렸다 씨발년아”라고 말하면서 주먹으로 피해자의 오른쪽 귀 부위를 1회 때렸다.
