However, even if the defendant receives a black box from the victim, he did not have the intention or ability to send a black box to the victim.

The Defendant, as such, by deceiving the victim, received KRW 15.8 million from the victim of the black boxes.

On April 15, 2010, the Defendant stated that “Around April 15, 2010, the Defendant sent KRW 5,115,000 won to the victim I by delivering 310 black boxes for vehicles to a new type” at the office of H Co., Ltd. located in Suwon-gu, Busan.

However, the facts are that the defendant has a debt equivalent to KRW 20 million, and even if he/she receives a black box from the victim, he/she has no intention or ability to send the black box to the victim, such as he/she lives with bad credit standing.

On April 16, 2010, the Defendant, by deceiving the victim, received KRW 5,115,00 from the victim to the new bank account under J’s name.
