피고인은 2015. 5. 15. 16:00경부터 같은 날 17:51경까지 서울 금천구 C, 502호에 있는 피고인의 집에서 피고인의 휴대전화를 이용하여 채팅 어플리케이션 D에 접속한 후 피해자 E(여, 27세)의 휴대전화로 “존나 따먹고 싶다 씨발 ㅋㅋ", “아직 20대셔서 섹시미를 잃지 않으셨네요”, “내 여자도 아닌데 정분을 느끼니 일처다부제였으면 하는 심정이 들었다고 생각해주세요”, “미친듯이 딸치고 자야겠음”, “원래도 하루~이틀에 1~5번 정도 딸치긴 했었는데 성욕이 갑자기 폭발하더니 요즘 하루에 열 번 가까이 딸쳐도 잠이 오기도 하고 그래요”, “ 씨는 제가 씨 남편보다 돈 많이 벌면 이혼한다던지 아니면 요즘엔 불륜도 합법이니까 저 만나줄건지 하는거에요”, “나중에 성공해서 돈 많이 벌면 강간하고 합의금주고 또 강간하고 합의금주고 빈털터리 될 때까지 강간해줄게요”, “아 존나 여자들한테 약오르니깐 강간야동에 쾌감을 느껴요”라는 등의 문자를 전송하였다.
