The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) shall pay KRW 36,512,621 to the Plaintiff (Counterclaim Defendant) and its related amount from September 30, 2014 to July 9, 2015.

Basic Facts

The Defendant was awarded a contract for “B construction (5th)” from the Republic of Korea (the jurisdiction of the East Sea Fisheries Management Council).

On October 11, 2012, the Defendant subcontracted the construction price of KRW 565,041,310 (including the amount before including the value added tax as to the construction price, hereinafter the same) to the Plaintiff, which is a part of the said construction (hereinafter referred to as “the instant fishing zone”) and the fishing theme park forecast zone (hereinafter referred to as “the instant fishing zone”).

The Maritime Development Project and the fishing of this case consisting of the process of “Gu body works, steel files works, and household facilities works,” and the construction cost for each process is determined as follows.

1. The construction work of 43,270 won for the 137,349,220 won for the diversatory works of this case and 22,523,700 won for the diversatory file works of this case;

2. Of the instant fishing club works, KRW 427,692,090, KRW 73,986,200, KRW 228,106,00, KRW 2200, KRW 125,599, KRW 890, KRW 565,041,310, KRW 565,00 and KRW 565,041, and KRW 310, among the instant fishing club works, the construction cost for each process of each of the instant works shall be determined as follows.

1. 22,523,700 won maritime ready-mixed 3,880,00 won for Spain 719,000 won for Spanish 10,724,700 won for steel reinforced processing and assembly (harbors) of reinforced concrete 1,724,700 won (harbors)

2. The Plaintiff is entitled to KRW 18,955,200, PLAT 11,400,000 for Spain 2,171,000 for Spain 11,40,000 for Spain 2,171,000 for Spain 26,380,000 for Spain.
